Obsedia Email Acceptable Use and Anti-Spam Policy
Version 1.1 · Last updated: 22 October 2026 · Effective from first publication
This policy forms part of the Obsedia Email Terms of Service provided by Genius Nutrition SRL, trading as OBSEDIA. It applies to merchants, authorised users, campaigns, automations, uploaded material, sending domains and any use of our infrastructure.
1. Permission-based marketing only
Use Obsedia Email only for recipients who have valid, demonstrable email-marketing consent for the merchant sending the message. Our service may impose this requirement even where a particular law permits another marketing basis. A purchase, customer-account registration, a public email address, social-media following or mere product-alert sign-in is not, by itself, proof of marketing consent.
Do not use bought, rented, borrowed, scraped, harvested, guessed or traded lists. Do not import another business's audience without both a lawful transfer and permission that actually covers the named sender and intended marketing. A statement in a CSV file is not sufficient evidence if the underlying consent was never obtained.
Keep auditable evidence of the subscription wording, sender identity, affirmative action, source and time. Provide it to OBSEDIA on a proportionate request for compliance review. If evidence is absent, disputed or inconsistent, we may stop the relevant audience or store's sending until eligibility is established.
2. Honest messages and effective opt-outs
Each marketing email must accurately identify the merchant, include its valid company/postal information, use an accurate subject and sender identity, and provide a clear, working unsubscribe route. Do not hide the link, use unreadable styling, require a purchase or login to unsubscribe, impose a fee, or disable standard unsubscribe headers.
Honour opt-outs, suppression, complaints and hard bounces. Do not reimport, change identities, create replacement tenants or use another sending domain to evade a restriction. A new lawful subscription must follow the supported consent flow and applicable verification; an old list upload must not override an opt-out.
Do not present a promotional campaign as a security alert, payment receipt, customer-support message or Shopify/AWS communication. Do not make deceptive claims about scarcity, delivery status, reviews, savings, health effects or discounts. Only use genuine offers, verified facts and authorised product links. The merchant remains responsible for approval of AI-generated copy, imagery and HTML before use.
3. Prohibited content and conduct
You must not use the service for:
- Fraud, phishing, credential theft, malware, malicious attachments, impersonation or deceptive links.
- Illegal products or services, unlawful discrimination, threats, harassment, exploitation, nonconsensual intimate imagery or content that violates others' intellectual-property or privacy rights.
- Content or targeted campaigns that unlawfully exploit a person's health, financial distress, religion, political beliefs or other sensitive traits.
- Processing special-category data, government identifiers, payment-card details, medical records or children's personal data without a separate written agreement and every legally required safeguard.
- Sending to spam traps, purchased leads, unverified mass audiences or addresses obtained by scraping.
- Interfering with the service, bypassing quotas or safety controls, unauthorised penetration tests, extracting another merchant's data, reselling access or using credentials outside their authorised scope.
- Evading a provider, platform, legal, billing or security restriction; falsely describing a development store as a paid store or the reverse; obscuring the actual sender; or disguising one customer's campaign as another's.
Products or industries subject to additional legal, carrier, mailbox-provider or infrastructure restrictions may require prior written review or may be unsupported. The presence of an editor or import feature is not authorisation to send every type of content.
4. Sending domains, infrastructure and reputation
Use only domains and addresses that you control or are authorised to use. Publish the exact verification records supplied for the relevant domain and do not remove required authentication. A verified domain does not establish that a mailing list is lawful or that every message will reach an inbox.
Shared sending capacity and default domains are platform resources. We may apply per-store or shared rate limits, fair queues, gradual onboarding, reviews and reputation controls. Requested sending speed, number of contacts or a scheduled time is not a guarantee of immediate provider acceptance. Messages may be delayed, rejected or stopped when compliance, provider quotas, consent, funds or service readiness cannot be verified.
Do not repeatedly retry an operation when its outcome is unknown. Use the application's reconciliation and support process; an unknown submission must not be treated as an invitation to resend.
5. Enforcement and investigations
We may investigate credible abuse reports, require consent evidence, restrict an affected feature, pause campaigns, suppress recipients or suspend access where reasonably necessary to protect individuals, other merchants, service integrity, legal compliance or provider reputation. We will use proportionate measures and provide notice and an opportunity to remedy where doing so is lawful and does not materially increase the risk. Urgent threats may require action before notice.
We may terminate material or repeated violations under the Terms. Unlawful content does not become permissible because charges have been paid. Usage already validly incurred remains subject to billing and reconciliation; this policy does not create an automatic penalty, confiscation of unrelated credits or off-platform charge.
6. Reporting abuse and challenging a restriction
Report suspected abuse or a malfunctioning unsubscribe to support@obsedia.ai. Include the sender/store, relevant message headers or campaign reference if available, and a description of the issue. Avoid sending unnecessary personal information or live credentials.
For privacy or personal-data concerns, use privacy@obsedia.ai. A merchant may ask support to review a restriction and provide relevant evidence. Investigation does not guarantee restoration if compliance or provider acceptance remains unresolved.
